Do you need to have a property release signed if a photo is being used commercially but not for profit?
I have a photo that has the back of 2 buildings in it. I would like to submit it for use as a stock photo. I’m not getting paid for it, but it will be used commercially.
Public and private buildings as photographic backgrounds are not subject to any kind of photographic release regardless of for profit or for free. However, if the background is misrepresented, discloses a particular address or is portrayed in an offensive manner; the offending photos are subject to private suits for defamation, etc.
