What to do when someone signed an auto title under duress?
My daughter is incarcerated for 90 days. Her deadbeat “boyfriend” drove her car home at the time she was arrested, and was supposed to return it to my house (mother). Instead, he went to visit her in county jail, lied and told her that i had said I wanted the car titled to him, and had her sign the title over to him. (This is a car I actually bought for her for $3000.00). She was distraught and under great duress at the time he saw her. Now, she is heartbroken that she signed the car over to him, and wants it back. Also, FYI, he has a suspended drivers license. Is there any legal recourse for us?
Check at the local DMV, chances are he hasn’t make the transfer yet. If it has not been done, you can probably put a hold on any transfer of title. Then go see the PD, explain what happened, and also mention he is driving under suspension. They can stop him, tow the car to impound and hold it until you straighten things out.
