Can a school Raise it’s tuition in the middle of the program after a enrollment agreement has been signed?
I attend a welding school. After finishing the first part and receiving a diploma I then decided to look into another program. I talked to my adviser and she worked up an enrollment agreement with payment plans. I based my decision to stay on this agreement. Now a few days ago midway through the program they called me to tell me I owed more money. Can they do this? I looked over the agreement and there is no fine print anywhere.

Generally, no, but the answer in any particular case will depend entirely on the language of the agreement. If the enrollment agreement is a proper contract, signed by both parties, and clearly states that the school agrees to provide such-and-such instruction in exchange for x dollars, then the school would be obligated to provide that instruction upon payment of x dollars, absent any contract language that allowed them to unilaterally adjust the tuition rate. You’ve said that you don’t see any such leeway, so it’s fair to ask your school to point out the language that enables them to make a change during the enrollment period covered by the agreement.
Obviously, it’s important to review the dates on the agreement, to determine what period of time the agreement was meant to cover. When the state universities in California raised their rates, mid-year, they were able to rely on the fact that they don’t sign “enrollment agreements” with their students. Every semester is a brand new registration period – leaving the schools free to adjust tuition before the start of any semester.
I would recommend that you make an appointment with the cashier’s office (or whoever is billing you), and I would bring a copy of your agreement. Ask them to point out the language that allows them to charge fees other than what’s stated in your agreement. If there’s no such language, and you attended the school in reasonable reliance on (apparently written) assurances that the tuition would be “$x”, then I would suspect that you’d have a pretty strong case if you had to take the matter to arbitration or litigation.
